Abstract

Where an employment relationship is infected in any way by illegality there is a danger of making a blanket assumption that all rights under contract and those deriving from statute are unenforceable. The reality is more complex and a deeper analysis is called for. The purpose of this article is to consider some aspects of this necessary analysis.
